Whistleblowing procedures in Norway

Chapter 2 A of the Norwegian Working Environment Act gives every employee the right to report censurable conditions, and requires most employers to have written internal procedures.

Who must have written procedures?

Undertakings with at least five employees must have written whistleblowing procedures. Smaller undertakings must have them if conditions warrant it.

Minimum content

  • an encouragement to report censurable conditions
  • how to report internally, and to whom
  • how the employer receives, handles and follows up reports
  • that reporting to a public authority is always permitted

Protection against retaliation

Retaliation against an employee who reports is prohibited. If the employee presents information giving reason to believe retaliation has occurred, the employer must prove otherwise.
